You may advertise, solicit, offer, accept orders, and sell within the Territory unless we give you written consent to serve another specified area where no other Punch King Fitness franchise or company-owned unit is located. If you are granted consent to service another specified area, you shall be obligated to pay us royalty fees and other fees for the services performed or products sold. What This Means (2024 FDD)

According to Punch King Fitness's 2024 Franchise Disclosure Document, franchisees are generally restricted from advertising outside of their designated territory without written consent from the franchisor. Specifically, franchisees do not have the right to use channels like the internet, catalog sales, telemarketing, or other direct marketing methods to make sales outside their territory unless they obtain written permission from Punch King Fitness to serve another specified area where no other franchise or company-owned unit is located. If consent is granted, the franchisee is obligated to pay royalty and other fees on services performed or products sold in that area.

This policy ensures that Punch King Fitness can control brand consistency and prevent market saturation or conflicts between franchisees. It also allows Punch King Fitness to manage and potentially profit from any expansion of a franchisee's reach beyond their initial territory. The franchisor also reserves the right to advertise, promote, market, or sell goods or services using the Punch King Fitness Marks over the internet, the World Wide Web or any other electronic network.

For a prospective franchisee, this means that their advertising efforts should primarily focus on their assigned territory unless they receive explicit approval to expand their marketing efforts elsewhere. It is important to understand the conditions under which such approval might be granted and the associated costs, such as royalty fees. Franchisees should also be aware that Punch King Fitness retains significant control over online advertising and social media related to the brand, which may limit a franchisee's autonomy in these areas. All advertising and promotional plans, materials, and other materials displaying the Marks must be submitted to Punch King Fitness for prior approval.

This restriction is fairly common in franchising, as franchisors typically want to maintain control over their brand and avoid internal competition between franchisees. However, the extent of the restriction and the process for obtaining permission to advertise outside the territory can vary significantly between franchise systems. Therefore, it is crucial for potential Punch King Fitness franchisees to carefully review the terms of the Franchise Agreement and discuss any concerns with the franchisor before investing.
