For each Punch King Fitness Franchised Business opened, what agreement must be signed?
Punch_King_Fitness Franchise · 2024 FDDAnswer from 2024 FDD Document
For each Franchised Business you open, you must sign a then-current form of the Punch King Fitness Franchise Agreement. For each future unit franchise agreement, you may be required to sign a form of the franchise agreement different from the franchise agreement included in this disclosure document. If you do not open your Franchised Businesses per the Development Schedule, we may terminate the Area Development Agreement, and you will lose the ability to develop other Punch King Fitness Franchised Businesses under the Area Development Agreement; we may keep the full development fee, which you paid; however, the Franchise Agreements for the Punch King Fitness Franchised Business already opened will not be terminated, because you did not follow the Development Schedule.

What This Means (2024 FDD)
According to Punch King Fitness's 2024 Franchise Disclosure Document, a franchisee must sign a Punch King Fitness Franchise Agreement for each franchised business they open. The FDD specifies that the agreement signed must be the then-current form of the Punch King Fitness Franchise Agreement. This implies that the specific terms and conditions could vary over time.
If a franchisee desires to open multiple Punch King Fitness locations, they may also enter into an Area Development Agreement. This agreement grants the franchisee the right to develop multiple Punch King Fitness locations within a specific area, according to a development schedule. However, regardless of whether an Area Development Agreement is in place, a separate Franchise Agreement is required for each individual Punch King Fitness business.
The FDD also notes that the form of the franchise agreement may change over time. Therefore, for each future unit, a franchisee may be required to sign a different version of the agreement than the one included in the current disclosure document. If the franchisee fails to adhere to the development schedule outlined in the Area Development Agreement, Punch King Fitness may terminate the agreement, and the franchisee could lose the ability to develop further Punch King Fitness locations. However, existing Franchise Agreements for already opened locations will remain in effect, even if the development schedule is not followed.
