What This Means (2024 FDD)
Based on the 2024 Franchise Disclosure Document, the provided excerpts do not explicitly state whether disputes with Punch King Fitness must be resolved through arbitration. While Item 22 discusses various aspects of the franchise agreement, including dispute resolution with clients and notification of legal proceedings, it does not mention arbitration as a mandatory method for resolving disputes between the franchisee and franchisor.
However, the franchise agreement does address dispute resolution with clients. Specifically, franchisees are expected to resolve client disputes promptly and fairly. If a franchisee fails to resolve a dispute, Punch King Fitness has the option to investigate and require the franchisee to take actions to resolve the dispute. This highlights the importance Punch King Fitness places on customer satisfaction and protecting the brand's reputation.
To fully understand the dispute resolution process, a prospective Punch King Fitness franchisee should carefully review the complete franchise agreement and consult with a legal professional. It is essential to clarify whether arbitration is required for disputes with the franchisor and to understand the implications of such a requirement.
