What This Means (2024 FDD)
According to Punch King Fitness's 2024 Franchise Disclosure Document, in addition to the service mark "Punch King Fitness," the company may designate other commercial symbols for use. These include trade names, trademarks, service marks, trade dress, designs, graphics, logos, emblems, insignia, fascia, slogans, drawings, and other commercial symbols. These marks are used in connection with the establishment and operation of a Punch King Fitness franchised business, which offers HITT boxing and kickboxing training, personal fitness training, nutritional services, and functional fitness training.
For a prospective franchisee, this means that Punch King Fitness has broad discretion to determine the branding and visual identity of the franchise. Franchisees must use the designated marks and symbols in their business operations to maintain a consistent brand image. This also implies that Punch King Fitness can change or update these symbols over time, and franchisees will be required to adapt accordingly.
The use of these marks is exclusive to the Punch King Fitness system, and franchisees are granted the right to use them only through the franchise agreement. Unauthorized use of these marks could lead to legal repercussions. Franchisees should ensure they understand and adhere to the guidelines provided by Punch King Fitness regarding the use of these commercial symbols to avoid any potential conflicts.
It is typical in franchising for franchisors to control branding elements tightly to ensure uniformity and protect brand recognition. The wide range of commercial symbols that Punch King Fitness may designate reflects the importance of a consistent brand image across all franchise locations. Prospective franchisees should inquire about any specific requirements or restrictions related to the use of these marks during their due diligence process.
