If no site has been designated at the time you sign the Franchise Agreement, you will select the site from within your Site Selection Area. The Site Selection Area is defined in your Franchise Agreement. During the Site Approval Period (which is the 12-month period following the date that we sign the Franchise Agreement), you must obtain our approval of the site for the Franchised Business and execute a lease or

purchase agreement for the approved site. If you do not obtain our approval for the site during the Site Approval Period, we, at our option, may terminate the Franchise Agreement. We have the right to move or modify the Site Selection Area any time during the Site Approval Period. The Site Selection Area will be determined on a case-by-case basis considering economic, demographic, and geographic information (such as population density). Provided that you are in full compliance with the Franchise Agreement, we and our affiliates will not operate, or license others to operate, Pump It Up Businesses in the Site Selection Area during the Site Approval Period.

What This Means (2025 FDD)

According to Pump It Up's 2025 Franchise Disclosure Document, the Site Selection Area is defined within the Franchise Agreement itself. If a site hasn't been chosen when the agreement is signed, the franchisee must select a location within this designated Site Selection Area.

The franchisee has a 12-month Site Approval Period from the date the Franchise Agreement is signed to secure Pump It Up's approval for their chosen site and finalize a lease or purchase agreement. Failure to obtain approval within this timeframe gives Pump It Up the option to terminate the Franchise Agreement. Pump It Up also retains the right to modify the Site Selection Area during this Site Approval Period.

The Site Selection Area is determined on a case-by-case basis, taking into account factors like economic conditions, population density, and geographic information. Provided the franchisee is compliant with the Franchise Agreement, Pump It Up and its affiliates will not operate or license others to operate Pump It Up businesses within the Site Selection Area during the Site Approval Period. Once the site is approved and all opening obligations are met, the franchisee gains the right to operate at the designated location and will be granted a Protected Area.
