Who is responsible for the costs of maintaining the Pump It Up Computer System?

You agree to incur the costs of maintaining the Computer System and any required service or support.
You will have sole and complete responsibility for: (a) the acquisition, operation, maintenance, modification and upgrading of the Computer System; (b) the manner in which your Computer System interfaces with our and any third party's computer system; and (c) any and all consequences if the Computer System is not properly protected, operated, maintained, and/or upgraded.
You are required to install and maintain protection of your software and hardware including, but not limited to, anti-virus, anti-malware and spam filters/firewalls.

What This Means (2025 FDD)
According to the 2025 Pump It Up Franchise Disclosure Document, the franchisee is responsible for the costs of maintaining the Computer System. Specifically, the franchisee agrees to incur the costs of maintaining the Computer System and any required service or support. This includes the acquisition, operation, maintenance, modification, and upgrading of the Computer System. The franchisee is also responsible for how their Computer System interfaces with Pump It Up's system or any third party's system. They are also responsible for protecting their software and hardware by installing and maintaining protection such as anti-virus, anti-malware, and spam filters/firewalls.
Pump It Up may provide a staffed help desk to assist with the initial setup of the POpS System. However, the franchisee is responsible for engaging with a third-party support company to help support and/or repair any network or hardware/software issues with their Computer System. While Pump It Up may offer troubleshooting tips for connectivity issues, the ultimate responsibility for maintaining the system rests with the franchisee.
Pump It Up, or its affiliates, may perform repair services for the computer or retain a third-party provider, or an Applications Service Provider (ASP) to provide some or all of the service and support for the computer for the benefit of the franchisee or all Pump It Up Businesses. In this case, the franchisee may have to pay a service or ASP hosting fee. However, Pump It Up has no obligation to reimburse the franchisee for any costs incurred relating to their computer system or other electronics. The franchisee must also use and maintain the Computer System according to Pump It Up's System Standards.
