Answer from 2025 FDD Document

We identify the System through the "Pump It Up" name and trademark and certain other names, trademarks, logos, insignias, slogans, emblems, symbols and designs (collectively, "Marks"), which we have designated, or may in the future designate, for use with the System.

The Marks are owned by our parent company, FB Holdings, LLC, and are licensed to us for use in the System.

What This Means (2025 FDD)

According to Pump It Up's 2025 Franchise Disclosure Document, the 'Marks' (names, trademarks, logos, insignias, slogans, emblems, symbols, and designs) associated with the Pump It Up System are owned by FB Holdings, LLC, the parent company of the franchisor. Pump It Up is licensed to use these Marks within the franchise system.

This arrangement is common in franchising, where a parent company owns the intellectual property and licenses it to a subsidiary franchisor. This structure allows the parent company to maintain overall control of the brand and its associated assets. For a Pump It Up franchisee, this means they are granted the right to use the brand's trademarks and other identifying marks, but they do not own them.

As a franchisee, it is crucial to adhere to the standards and guidelines set by Pump It Up for using the Marks. This ensures brand consistency and protects the overall value of the franchise system. Any unauthorized use of the Marks could result in legal action or termination of the franchise agreement. Franchisees also contribute to a Brand Fund, which is used to enhance and protect the System and the Marks through advertising, marketing, and public relations programs.
