Is Pump It Up obligated to reimburse franchisees for computer system costs?

We have no obligation to reimburse you for any costs that you incur relating to your computer system or other electronics.
- (4) We or our affiliates may condition any license of proprietary software to you, or your use of technology that we or our affiliates develop or maintain, on your signing a software license agreement or similar document that we or our affiliates prescribe to regulate your use of, and our and your respective rights and responsibilities with respect to, the software or technology.
We or our affiliates may charge you a monthly or any other fee for any proprietary software or technology that we or our affiliates license to you and for other maintenance and support services that we or our affiliates provide during the term of this Agreement.
- (5) You must use and maintain the Computer System according to our System Standards.

What This Means (2025 FDD)
According to Pump It Up's 2025 Franchise Disclosure Document, franchisees are responsible for all costs associated with their computer systems, and Pump It Up has no obligation to reimburse these expenses. Franchisees are also responsible for engaging with a third-party support company to address network, hardware, or software issues. Pump It Up may offer help desk support for the initial setup, but they reserve the right to charge a fee for this assistance at their current hourly rates.
Pump It Up, or its affiliates, may provide repair services or retain a third-party provider or Application Service Provider (ASP) for computer service and support. In such cases, franchisees may be required to pay a service or ASP hosting fee. Furthermore, Pump It Up may condition the license of proprietary software or technology on the franchisee signing a software license agreement and may charge monthly or other fees for the use of such software, technology, maintenance, and support services.
This means that a prospective Pump It Up franchisee should be prepared to cover all expenses related to the computer system necessary for operating the franchise. These costs can include hardware, software, installation, maintenance, and support services. Franchisees should factor these expenses into their overall investment and operating budget. It is important to understand that Pump It Up does not offer reimbursement for these costs, and franchisees are responsible for managing and maintaining their computer systems in accordance with Pump It Up's System Standards.
