NOTICES AND PAYMENTS.** No notice, demand, request or other communication to the parties will be binding upon the parties unless the notice is in writing, refers specifically to this Agreement and: (A) if to us, is sent to 4343 E.
Outlier Blvd., Suite 220, Phoenix, AZ 85008 (Attn: Legal Department); or (B) if to you, is sent to the address and to the individual specified on Exhibit 4 or is sent to the premises of the Franchised Business.
Any party may designate a new address for notices by giving written notice of the new address pursuant to this section. notices will be effective upon receipt (or first refusal of delivery) and may be: (1) delivered personally; (2) transmitted by facsimile or electronic mail to the email address(es) or number(s) set forth above (or in Exhibit 4); (3) mailed in the united states mail, postage prepaid, certified mail, return receipt requested; or (4) sent via overnight courier.

What This Means (2025 FDD)
According to Pump It Up's 2025 Franchise Disclosure Document, any formal communication, such as a notice, demand, or request, must be in writing and specifically reference the Franchise Agreement to be considered binding.
If Pump It Up needs to send a notice to the franchisee, it should be sent to the address and individual specified on Exhibit 4 of the Franchise Agreement or to the physical location of the franchised Pump It Up Business. Conversely, if the franchisee needs to send a notice to Pump It Up, it should be sent to 4343 E. Outlier Blvd., Suite 220, Phoenix, AZ 85008, and addressed to the Legal Department.
Either party can change their designated address for receiving notices by providing written notice of the new address, following the guidelines outlined in the agreement. Notices are considered effective upon receipt or the first refusal of delivery. Acceptable methods of delivery include personal delivery, transmission by facsimile or email to the addresses or numbers specified in the agreement or Exhibit 4, mailing via certified mail with return receipt requested, or sending via overnight courier.
