The initial term of this Agreement ("Initial Term") and the Franchise granted by this Agreement will begin on the Effective Date and expire at midnight on the day preceding the 10th anniversary of the date the Franchised Business first opens for business, unless this Agreement is terminated at an earlier date pursuant to Section 19.

What This Means (2025 FDD)

According to Pump It Up's 2025 Franchise Disclosure Document, the initial term of the Franchise Agreement begins on the effective date and extends until midnight on the day preceding the 10th anniversary of when the franchised business first opens. However, this agreement can be terminated earlier under certain conditions as outlined in Section 19 of the agreement. Pump It Up will document the date the franchised business first opened.

As a Pump It Up franchisee, it's important to note that you have the option to request to continue as a franchisee at your current location after the initial term expires. To do so, you must provide written notice between 10 and 18 months before the end of the initial term, pay a successor term fee, not be in default under any agreements, have the right to remain in possession of the premises, and renovate the business to meet current Pump It Up standards.

If a Pump It Up franchisee continues to operate the Pump It Up business beyond the initial term or any subsequent renewal period, it will be considered a month-to-month arrangement under the terms of the agreement. This arrangement is subject to termination with a 30-day notice or as required by law. If this hold-over period exceeds 90 days, the agreement is subject to immediate termination, unless a longer period is required by applicable law.
