You would like to obtain a license to use the System and the Marks and to operate a franchised Pump It Up Business (the "Franchised Business") at the location specified in Exhibit 1 (the "Premises"), subject to the terms and conditions of this Agreement and in strict compliance with the high and uniform standards of quality, operations and service established by us for the System (the "System Standards").

What This Means (2025 FDD)
According to the 2025 Pump It Up Franchise Disclosure Document, the franchisee is granted a license to operate a Pump It Up Business at a specific location, referred to as the Premises. This operation must strictly adhere to the high and uniform standards of quality, operations, and service established by Pump It Up. The franchisee acknowledges the importance of these System Standards and commits to operating the Franchised Business in strict conformity with the Franchise Agreement, System Standards, and Pump It Up operations manuals.
Pump It Up retains significant control over the use of the premises. The franchisee must secure a lease agreement for the premises no later than 12 months from the agreement's effective date. The franchisor must approve the premises. The franchisee must open the Franchised Business within a specific timeframe: either six months from securing the lease or 18 months from the agreement's effective date, whichever comes first.
Pump It Up also has the right to require the franchisee to remodel, expand, redecorate, re-equip, and/or refurnish the Premises to conform to the image of the System for new Pump It Up Businesses. Franchisees must maintain possession of the premises for the entire duration of the franchise agreement, including any renewal terms. The franchisee cannot alter the lease without the franchisor's written consent and must exercise all options to extend or renew the lease, or Pump It Up can act on their behalf.
Overall, the permitted use of the premises is tightly controlled by Pump It Up to ensure brand consistency and adherence to System Standards. Franchisees have limited flexibility in how they use the premises and must comply with Pump It Up's directives regarding operations, appearance, and lease management.
