What This Means (2025 FDD)
According to Pump It Up's 2025 Franchise Disclosure Document, Pump It Up has the option to file a lawsuit against a franchisee in specific jurisdictions. Pump It Up can file suit in the federal or state court located in the jurisdiction where their principal offices are located at the time suit is filed. As of the date of the Franchise Agreement, those courts are the Superior Court of Arizona, Maricopa County and the United States District Court for the District of Arizona in Phoenix, Arizona.
Alternatively, Pump It Up can file suit in the jurisdiction where the franchisee resides or does business. They can also file suit where the franchised business is or was located, or where the claim arose. The franchisee consents to the personal jurisdiction of those courts and to venue in those courts.
This means that a Pump It Up franchisee could potentially face legal action from Pump It Up in their home state, where their business operates, or in Arizona, where Pump It Up's principal offices are located. This clause ensures that Pump It Up has multiple options for pursuing legal claims against franchisees, potentially creating a logistical and financial challenge for franchisees involved in disputes.
