What This Means (2025 FDD)
According to the 2025 Pump It Up Franchise Disclosure Document, the "Premises" refers to the physical location specified in Exhibit 1 where the franchisee will operate the Pump It Up Business. This location is subject to the terms and conditions outlined in the Franchise Agreement and must adhere to the high standards of quality, operations, and service established by Pump It Up. The franchisee is granted the opportunity to develop and operate the franchised business at this specific location, contingent upon compliance with the Franchise Agreement.
Before opening a Pump It Up franchise, the franchisee is responsible for preparing a site survey of the proposed Premises and ensuring that all construction plans and specifications comply with the Americans with Disabilities Act (ADA) and other applicable local ordinances, building codes, and permit requirements. The franchisee must also retain a licensed architect to develop construction drawings, including architectural, mechanical, plumbing, and electrical plans. These plans may need to be submitted to Pump It Up for review before construction begins.
The franchisee is responsible for securing financing, obtaining necessary insurance coverage, and procuring all required building, utility, sign, health, sanitation, occupancy, business, and other permits and licenses for the Premises. They must also construct all required improvements to the Premises and furnish and decorate the franchised business according to Pump It Up's approved plans and specifications. The franchisor may require the franchisee to remodel, expand, redecorate, re-equip, or refurnish the Premises to conform to the image of new Pump It Up businesses, with certain limitations on the frequency and cost of major redesigns, except when required by the ADA or new safety standards.
