Can Pump It Up or its affiliates perform repair services for the computer system?

h a third-party support company to help you support and/or repair any network or hardware/software issues with your Computer System. We reserve the right to charge a fee for our help desk support at our then-current hourly rates. You agree to incur the costs of maintaining the Computer System and any required service or support. We or our affiliates may perform repair services for the computer or retain a third-party provider, or an Applications Service Provider ("ASP") to provide some or all of the service and support for the computer for your benefit or the benefit of all Pump It Up Businesses, and you may pay a service or ASP hosting fee. We have no obligation to reimburse you for any costs that you incur relating to your computer system or other electronics.
- (4) We or our affiliates may condition any license of proprietary software to you, or your use of technology that we or our affiliates develop or maintain, on your signing a software license agreement or similar document that we or our affiliates prescribe to regulate your use of, and our and your respective rights and responsibilities with respect to, the software or technology. We or our affiliates may charge you a monthly or any other fee for any proprietary software or technology that we or our affiliates license to you and for other maintenance and support services that we or our affiliates provide during the term of this Agreement.
- (5) You must use and maintain the Computer System according to our System Standards. You will have sole and complete responsibility for: (a) the acquisition, operation, maintenance, modification and upgrading of the Computer System; (b) the manner in which your Computer System interfaces with our and any third party's computer system; and (c) any and all consequences if the Computer System is not properly protected, operated, maintained, and/or upgraded.

What This Means (2025 FDD)
According to Pump It Up's 2025 Franchise Disclosure Document, Pump It Up or its affiliates may perform repair services for the computer system. Alternatively, Pump It Up can retain a third-party provider or an Applications Service Provider (ASP) to provide service and support. As a franchisee, you may be required to pay a service or ASP hosting fee for these services.
Pump It Up also provides a staffed help desk to assist with the initial setup of the POpS System for the franchisee or their employees. While the help desk can offer troubleshooting tips for connectivity issues, franchisees are responsible for engaging a third-party support company for any network, hardware, or software issues with the computer system. Pump It Up reserves the right to charge a fee for help desk support at their current hourly rates.
The franchisee is responsible for covering the costs of maintaining the computer system and any required service or support. Pump It Up is not obligated to reimburse franchisees for any expenses related to their computer system or other electronics. Pump It Up may also condition the license of proprietary software or technology on the franchisee signing a software license agreement, and may charge a monthly or other fee for the use of such software, technology, maintenance, and support services.
