What This Means (2025 FDD)

According to the 2025 Precision Door Service FDD, the addendum to the Development Agreement for developers in Wisconsin is effective only if the jurisdictional requirements of the Wisconsin Fair Dealership Law are met independently of the addendum. This means that the provisions of the addendum will only apply if the legal conditions for applying the Wisconsin Fair Dealership Law are satisfied, regardless of the addendum itself.

In practical terms, this ensures that Precision Door Service developers in Wisconsin receive the protections and rights afforded to them under Wisconsin law. The Wisconsin Fair Dealership Law will take precedence over any conflicting terms in the Development Agreement. This protects the developer from potentially unfair or disadvantageous terms in the original agreement.

This conditionality is a common practice in franchising to ensure compliance with state-specific franchise laws, which vary significantly. By making the addendum's effectiveness contingent on meeting the jurisdictional requirements of Wisconsin law, Precision Door Service aims to avoid potential legal conflicts and ensure that the franchise agreement operates within the bounds of state regulations. Prospective developers should familiarize themselves with the Wisconsin Fair Dealership Law to fully understand their rights and obligations.
