What This Means (2025 FDD)
According to Petro Stopping Center's 2025 Franchise Disclosure Document, Minnesota franchisees are provided specific termination and non-renewal rights under Minnesota law. Specifically, Minnesota Statute §80C.14, Subd. 3, 4, and 5, requires that Petro Stopping Center provide a franchisee with ninety (90) days' notice of termination, which includes sixty (60) days to cure the reasons for termination.
This means that if Petro Stopping Center decides to terminate a franchise agreement in Minnesota (except in certain specified cases), the franchisee will receive a 90-day notice. Within that 90-day period, the franchisee has 60 days to correct the issues that led to the termination notice. If the franchisee successfully addresses these issues within the 60-day cure period, Petro Stopping Center cannot terminate the agreement.
Additionally, for non-renewal of the franchise agreement, Minnesota law requires Petro Stopping Center to provide the franchisee with one hundred eighty (180) days' notice. This longer notice period for non-renewal allows the franchisee more time to prepare for the end of the franchise term and potentially negotiate a new agreement. These stipulations are added as amendments to Sections 18.2 and 18.3 of the standard franchise agreement to comply with Minnesota law.
