What This Means (2025 FDD)
According to the 2025 Petro Stopping Center FDD, franchisees are restricted in how they can identify themselves after a transfer of ownership. Specifically, franchisees (and their owners/spouses) must agree not to identify themselves or any business as a current or former Petro Center, or as one of Petro Stopping Center's licensees or franchisees.
This restriction extends to using any mark, imitation of a mark, or other indication of a Petro Center. Franchisees also cannot use any trade name, trade or service mark, or other commercial symbol that suggests a connection with Petro Stopping Center. This is only with respect to Petro Centers that the franchisee does not own and operate.
This clause aims to protect the Petro Stopping Center brand and prevent confusion among customers after a franchise changes hands. It ensures that the new owner can establish their own identity without trading on the goodwill of the Petro Stopping Center brand, except for other Petro Stopping Centers the franchisee owns and operates. Franchisees should carefully consider these restrictions before agreeing to a transfer, as they could impact future business ventures.
