What This Means (2025 FDD)
According to the 2025 Petro Stopping Center Franchise Disclosure Document, the term 'Site' refers to the physical location where the Petro Center is situated. The franchise agreement emphasizes that a franchisee must operate their Petro Center exclusively from the approved Site, and any reference to the Site within the agreement inherently includes the Petro Center itself.
The franchisor retains significant control over site selection. The franchisee, with or without assistance from Petro Stopping Center, must locate a site that meets the franchisor's approval. The criteria for site approval may include various factors such as demographic characteristics, traffic patterns, parking availability, competition, proximity to other businesses and Petro Stopping Centers, and the physical characteristics of the proposed site. These criteria and their evaluation can change periodically and may vary from location to location.
Furthermore, the franchisee is prohibited from operating the Petro Center from any location other than the approved Site without prior written consent from Petro Stopping Center. If a mutually agreed-upon Site is determined by the agreement date, it will be specified in Exhibit "C" of the franchise agreement. Otherwise, the Site will be designated in Exhibit "C" upon the franchisor's approval. This Site approval process underscores the importance of securing a location that aligns with Petro Stopping Center's strategic objectives and operational standards.
