What This Means (2025 FDD)

According to the 2025 Pearce Bespoke Franchise Disclosure Document, upon the expiration or termination of the Franchise Agreement, a franchisee must either return all confidential information, including customer lists and records, to Pearce Bespoke or, at Pearce Bespoke's request, destroy all or certain confidential information. If the franchisee destroys the confidential information, they must certify such destruction to Pearce Bespoke. This includes customer lists and any other confidential data related to the business.

Pearce Bespoke retains ownership of all customer lists and information generated by the franchise. This means that even though the franchisee gathers this data through their business operations, Pearce Bespoke has the right to use this information for marketing purposes, both during and after the franchise agreement term. The franchisee must also execute any documents required by Pearce Bespoke to ensure the franchisor has access to this information.

This clause highlights the importance of data management and protection within the Pearce Bespoke franchise system. Franchisees must be diligent in handling customer information and understand that this data ultimately belongs to the franchisor. The requirement to certify the destruction of confidential information ensures accountability and protects Pearce Bespoke's proprietary assets. Prospective franchisees should carefully consider these obligations and ensure they have the systems in place to comply with these requirements.
