What This Means (2025 FDD)
According to the 2025 Pearce Bespoke Franchise Disclosure Document, the franchisee acknowledges several key points regarding their territory and the franchisor's role. The franchisee agrees that the territory was mutually decided upon with Pearce Bespoke. They also confirm they conducted their own due diligence regarding potential customers and operational factors within that territory before the agreement's effective date.
Crucially, the franchisee understands that Pearce Bespoke's approval of the territory is simply permission to operate there. It does not constitute any representation, promise, warranty, or guarantee, either express or implied, that the Pearce Bespoke franchise will be profitable or successful in that territory. This means Pearce Bespoke is not liable if the franchise underperforms or fails to meet financial expectations.
This acknowledgement is a standard practice in franchising, where the franchisee bears the ultimate responsibility for the success of their individual business. While Pearce Bespoke may provide support, training, and brand recognition, the franchisee's own efforts, market conditions, and business acumen will largely determine profitability. Prospective franchisees should carefully consider this when evaluating the opportunity and conducting their own independent research.
