What This Means (2025 FDD)
According to Pearce Bespoke's 2025 Franchise Disclosure Document, the employees operating the Franchised Business must be employees of the franchisee. The agreement explicitly states that none of the franchisee's employees will be considered employees of the franchisor. Pearce Bespoke maintains complete independence in its employment relationships with its staff.
This distinction is crucial because it clarifies that Pearce Bespoke, the franchisor, has no direct control over the franchisee's employees' terms and conditions of employment. The franchisee has the sole discretion to determine these essential terms, as defined in the Operations Manual or by law. This includes decisions related to hiring, firing, compensation, and day-to-day management of the employees.
Furthermore, the franchisee is solely responsible for the safety and well-being of their employees and customers at the Pearce Bespoke Franchise. This responsibility extends to all matters of safety and security within the franchise. The franchisee also agrees to indemnify Pearce Bespoke against any claims related to safety or security, reinforcing the franchisor's lack of direct control over these aspects of the franchisee's business operations.
This arrangement is typical in franchising, where franchisees operate as independent business owners. It is important for prospective Pearce Bespoke franchisees to understand that they will bear all responsibilities and liabilities associated with being an employer, including compliance with labor laws, insurance requirements, and other employment-related regulations.
