What This Means (2025 FDD)
According to the 2025 Pearce Bespoke Franchise Disclosure Document, Section 3.E of the Franchise Agreement addresses substitutions related to the brand's Marks. If Pearce Bespoke determines it necessary or advisable, the franchisee must immediately implement any changes, amendments, or discontinuations to any or all of the Marks as required by Pearce Bespoke upon receiving written notice. The franchisee bears the expense of these changes.
Furthermore, the franchisee is prohibited from independently making any changes, amendments, or discontinuations to the use of any of the Marks and Business System unless specifically directed to do so in writing by Pearce Bespoke. This provision ensures that the brand maintains control over its image and standards, and that franchisees adhere to any updates or modifications deemed necessary by the franchisor.
This section highlights the importance of adhering to Pearce Bespoke's brand standards and the franchisor's right to modify those standards. It also clarifies that the franchisee is responsible for the costs associated with implementing any required changes to the Marks. Prospective franchisees should be aware of this obligation and factor it into their financial planning.
