What This Means (2025 FDD)
According to the 2025 Pearce Bespoke FDD, franchisees are explicitly prohibited from using confidential information in any business or capacity other than the Pearce Bespoke Business. This restriction is part of the Confidentiality and Restrictive Covenant Agreement that franchisees must adhere to.
The agreement specifies that franchisees must maintain the confidentiality of the information at all times and prevent unauthorized use or disclosure. This obligation extends to not making unauthorized copies of documents containing confidential information and ceasing the use of such information immediately upon request from Pearce Bespoke.
This restriction is designed to protect Pearce Bespoke's proprietary information, including methods, customer data, and operational procedures, from being used to benefit competitors or for purposes outside the scope of the franchise agreement. The FDD emphasizes that failure to comply with these terms will cause irreparable harm to Pearce Bespoke and its franchisees, potentially leading to injunctive relief.
