However, we have the absolute right to reject any site not meeting our criteria or to require you to acknowledge in writing that a site you have chosen, while acceptable to us, is not recommended due to its incompatibility with certain factors bearing on a site's suitability as a location for a Nothing Bundt Cakes® Bakery.

We agree to use reasonable efforts to review and accept (or not to accept) sites you propose within thirty (30) days after we receive all requested information and materials.

What This Means (2025 FDD)

According to Nothing Bundt Cakes' 2025 Franchise Disclosure Document, franchisees are responsible for locating, evaluating, and selecting their Bakery site. While Nothing Bundt Cakes provides its criteria for acceptable sites, the franchisee makes the initial selection. Nothing Bundt Cakes has the right to review and either accept or reject the proposed location.

Nothing Bundt Cakes has the absolute right to reject a site if it does not meet their established criteria. Even if a site is acceptable to Nothing Bundt Cakes, they can require the franchisee to acknowledge in writing that the site is not recommended due to incompatibility with factors affecting its suitability. This suggests that even if a franchisee insists on a site, Nothing Bundt Cakes can protect itself by documenting the risks.

Nothing Bundt Cakes agrees to review proposed sites within thirty days of receiving all necessary information. The franchisee cannot proceed with a site that Nothing Bundt Cakes has not accepted. Furthermore, Nothing Bundt Cakes must provide written consent for any lease or sublease, which they will not unreasonably withhold. However, if the franchisee fails to sign a franchise agreement or cannot obtain lawful possession of the site, Nothing Bundt Cakes may withdraw their consent.

Prospective franchisees should pay close attention to Nothing Bundt Cakes' site selection criteria and communicate openly with the franchisor during the site selection process. Understanding the reasons behind a potential rejection is crucial to finding a suitable location and avoiding delays or complications in opening their Nothing Bundt Cakes Bakery.
