What standards and specifications does Nothing Bundt Cakes provide for opening a Bakery?

Agreement, we will undertake the following:
- Protected Territory. We will define the territory within which you must operate the Bakery. (Section 1.2 of the Franchise Agreement; Sections 3 and 6 of the Development Rights Rider).

- Standards and Specifications. We will provide you with specifications and requirements for flooring, signage, shelving, display cases, POS systems, computer hardware, software, and other furniture, fixtures, and equipment necessary to open your Bakery. We will also provide you with specifications for and provide you with a list of approved and designated suppliers from which you agree to purchase the equipment, food, smallwares, and other inventory and supplies necessary for the start-up and ongoing operations of your Bakery. (Section 5.3 of the Franchise Agreement). We do not deliver or install these items.

- Operations Manual. We will loan you a copy of our proprietary and confidential Operations Manual electronically, which we may amend periodically. The Table of Contents to our 549 page Operations Manual is attached as Exhibit E to this Disclosure Document. We reserve the right to provide the Operations Manual electronically, such as by CD-ROM or a password protected intranet website. The contents of the Operations Manual constitute our trade secrets and you cannot disclose them to anyone other than employees of your Bakery who require such information to operate your Bakery. (Section 5.5 of the Franchise Agreement).

- Site Selection Assistance. We will provide assistance in finding a location as we deem reasonable and appropriate. You must collaborate with our designated licensed commercial real estate broker in connection with the selection and acquisition of a site for the Bakery. You will operate the Bakery at the location agreed upon by you and us. You will enter into the site selection addendum attached as Exhibit 1 to the Franchise Agreement and designate your site selection territory. (Section 4.1 of the Franchise Agreement, Exhibit 1 to the Franchise Agreement). We consider factors such as size, location, nearby commercial and residential development, traffic patterns, demographics, visibility from roadways, and parking space in approving any given site. Your leased/purchased space should be approximately 2,000 square feet, located in a strip center, shopping center, mall, commercial development or other appropriate location. Within 30 days of receiving all required information in connection with site approval process, we will approve or disapprove, in our sole discretion, the site as a location for the Bakery. No proposed site is deemed approved unless we have expressly approved it in writing.

According to Nothing Bundt Cakes' 2025 Franchise Disclosure Document, the company provides franchisees with specific standards and requirements to ensure uniformity across all locations. Franchisees must purchase or lease a location that meets the franchisor's standards and specifications within 90 days of the Franchise Agreement's effective date. The selected space should be approximately 2,000 square feet and located in an appropriate setting such as a strip center, shopping center, or commercial development. Nothing Bundt Cakes considers factors like size, location, nearby developments, traffic patterns, demographics, visibility, and parking when approving a site. The franchisee must use Nothing Bundt Cakes' designated licensed commercial real estate broker for site selection.
Nothing Bundt Cakes also requires franchisees to participate in any System-wide computer network, intranet, or extranet system that they implement. Franchisees must use these systems in compliance with the standards, protocols, and restrictions outlined in the Operations Manual or in writing, including those related to data encryption and prohibitions against libelous statements. Nothing Bundt Cakes reserves the right to charge a monthly service fee for these technology services and can modify these fees at their discretion. Franchisees are also required to install the POS system that Nothing Bundt Cakes designates, which includes computer hardware and software components.
