What This Means (2025 FDD)
According to Nothing Bundt Cakes' 2025 Franchise Disclosure Document, you must submit any lease or sublease agreement to Nothing Bundt Cakes for written acceptance before signing it. Nothing Bundt Cakes states that they will not unreasonably withhold this acceptance.
While Nothing Bundt Cakes requires you to locate, evaluate, and select the bakery site, they will provide their current criteria for bakery sites to assist you in the selection process. These criteria include factors such as population density, demographic characteristics, visibility, traffic flow, competition, accessibility, size, and other physical and commercial characteristics. However, Nothing Bundt Cakes has the absolute right to reject any site that does not meet their criteria or to require you to acknowledge in writing that a chosen site, while acceptable, is not recommended due to incompatibility with certain factors.
Nothing Bundt Cakes agrees to use reasonable efforts to review and either accept or reject proposed sites within 30 days after receiving all requested information and materials. It is important to note that you cannot proceed with a site that Nothing Bundt Cakes has not accepted. While Nothing Bundt Cakes may offer guidance in the leasing process, they are not obligated to do so and will not negotiate the lease or sublease for you or provide any legal advice.
