What This Means (2025 FDD)

According to the 2025 Nothing Bundt Cakes Franchise Disclosure Document, the franchisee is solely responsible for all employment decisions at their bakery. This includes, but is not limited to, employee selection, promotions, terminations, work hours, pay rates, benefits, work assignments, disciplinary actions, grievance adjustments, complaints, and working conditions. Nothing Bundt Cakes, as the franchisor, and its affiliates are not considered the employer or joint employer of the bakery personnel.

This means that as a Nothing Bundt Cakes franchisee, you have complete autonomy over your staff and must handle all aspects of employment independently. You are responsible for ensuring that your bakery complies with all applicable employment laws, ordinances, and regulations.

This arrangement is typical in franchising, where franchisees are independent business owners. However, it also means that the franchisee bears the full responsibility and liability for any employment-related issues that may arise at their Nothing Bundt Cakes location. The franchisee also acknowledges that Nothing Bundt Cakes has no responsibility to ensure the Bakery is developed and operated in compliance with all applicable laws, ordinances, and regulations, and that they shall have no liability if the development or operation of the Bakery violates any law, ordinance or regulation.

Prospective franchisees should carefully consider the implications of being solely responsible for all employment matters, including the potential legal and financial risks involved.
