What This Means (2025 FDD)
According to the 2025 Nothing Bundt Cakes FDD, you are not allowed to proceed with a site that the franchisor has not accepted. The FDD states that the franchisee is responsible for locating, evaluating, and selecting the Bakery's site, and Nothing Bundt Cakes will not search for or select the site for the franchisee.
Nothing Bundt Cakes will provide its criteria for Bakery sites, including factors like population density, visibility, traffic flow, competition, accessibility, size, and other physical and commercial characteristics. While Nothing Bundt Cakes has the right to reject any site that does not meet their criteria, they also state that they will not unreasonably withhold acceptance of a site if it aligns with favorable or successful sites based on their experience.
Before signing any lease or sublease, the franchisee must submit it to Nothing Bundt Cakes for written consent, which the franchisor will not unreasonably withhold. The franchisor may offer guidance in the leasing process but will not negotiate the lease or provide legal advice. Failing to obtain the franchisor's approval for the site can result in not being able to move forward with that location.
