What This Means (2025 FDD)

According to Nothing Bundt Cakes' 2025 Franchise Disclosure Document, franchisees are restricted from using confidential information, including supplier networks, for competitive purposes, even after the franchise agreement ends. The FDD states that "Confidential Information" includes lists of supplier networks associated with Nothing Bundt Cakes franchises. This information is considered not generally known or easily accessible and is important for operating a Nothing Bundt Cakes franchise.

Specifically, the agreement emphasizes that sales and marketing techniques, knowledge and experience used in developing and operating Nothing Bundt Cakes franchises, and pricing plans through supplier networks are considered confidential. This suggests that franchisees are expected to maintain the confidentiality of these details, which are crucial for the brand's operations and competitive advantage.

Therefore, a former Nothing Bundt Cakes franchisee would likely be prohibited from contacting Nothing Bundt Cakes' suppliers to gain an unfair advantage in a competitive business. This restriction aims to protect the franchisor's established relationships and proprietary information, ensuring that former franchisees do not leverage insider knowledge to the detriment of the Nothing Bundt Cakes system.
