Does the Nothing Bundt Cakes franchise agreement allow for extensions to the initial 10-year term?

According to the 2025 Nothing Bundt Cakes Franchise Disclosure Document, the franchise agreement allows for one additional 10-year term. The initial franchise term begins when Nothing Bundt Cakes signs the Franchise Agreement and continues for 10 years from the Bakery opening date. If a franchisee purchases an existing Bakery from another franchisee, the term will be for the remaining unexpired term of the seller's franchise agreement. The Development Rights Rider term depends on development obligations and cannot be renewed or extended.

To renew the franchise agreement for the additional 10-year term, a Nothing Bundt Cakes franchisee must meet several requirements. These include providing notice of renewal no fewer than 3 months and no greater than 9 months before the end of the current term. The franchisee must also demonstrate that they have the right to operate at the approved location for the renewal term, or secure a substitute location acceptable to Nothing Bundt Cakes if they cannot continue at the original location.

Additional requirements for renewal include completing a reimage survey between 6 and 12 months prior to the expiration of the current term to plan for reimage investments. The franchisee must also demonstrate financial capability to operate the Bakery for the renewal term by providing financial records as requested by Nothing Bundt Cakes. Furthermore, the franchisee must complete all necessary maintenance, refurbishing, reimaging, renovations, and updates to the Bakery premises to comply with Nothing Bundt Cakes' current system standards for new franchisees, no later than 90 days before the current term expires.

Finally, the franchisee must not be in breach of any agreement with Nothing Bundt Cakes, its affiliates, or approved suppliers, and must satisfy all monetary obligations to these parties. They must also complete any then-current training requirements for renewing franchisees and execute the then-current form of Franchise Agreement. Meeting all these conditions is essential for a Nothing Bundt Cakes franchisee to secure the additional 10-year term.
