Franchisee expressly acknowledges and agrees that failure to timely comply with any renovation, modernization and improvements required under subsection (vi) of Section 17.01 in connection with the renewal of the franchise shall be deemed a material default which, if not timely cured after notice, may result in termination of the Renewal Franchise Agreement.
