What This Means (2025 FDD)

According to Mrcool's 2025 Franchise Disclosure Document, Mrcool has the unilateral right to reject any and all advertising related to the Franchised Business. This extends to advertising related to Mrcool itself, the System, MRCOOL Centers, and/or advertising using the Licensed Marks. This means that a franchisee's advertising plans are subject to approval by Mrcool.

This provision gives Mrcool significant control over how its brand is presented and marketed. It ensures that all advertising aligns with Mrcool's standards and specifications. A franchisee must ensure that all advertising and promotion of the Franchised Business is completely factual, conforms to the highest standards of ethical advertising, and is in conformity with Mrcool's standards and specifications.

This level of control is common in franchising, where maintaining brand consistency is crucial. However, it also means that franchisees have limited autonomy in their marketing efforts and must work closely with Mrcool to develop and execute advertising campaigns. Franchisees must also refrain from any business practice, advertising practice, or personal conduct that may be injurious to Mrcool, the System, MRCOOL Centers, and the Licensed Marks.

Prospective franchisees should carefully consider this restriction and discuss with Mrcool the types of advertising that are typically approved and any potential limitations on their marketing strategies. Understanding Mrcool's advertising standards and approval process is essential for a successful franchise operation.
