What This Means (2025 FDD)

Yes, according to Mrcool's 2025 Franchise Disclosure Document, franchisees are required to operate under a distinctive trade dress. The FDD states that the Mrcool System, which each Center utilizes, is identified by the Licensed Marks and distinctive trade dress. This trade dress is part of the overall System that Mrcool may modify from time to time.

The term "Licensed Marks" is defined to include the "MRCOOL" trademark, the MRCOOL logo, Trade Dress, and other trademarks, service marks, logos, slogans and designs authorized by Mrcool in connection with the identification of MRCOOL Centers and the Approved Services and Products. Mrcool retains the right to modify, replace, and discontinue these Licensed Marks at its discretion.

This means that as a franchisee, you must adhere to the specific branding and appearance guidelines set by Mrcool, which includes using the designated trademarks, logos, and overall trade dress. This ensures consistency across all Mrcool locations and reinforces brand recognition. Failure to comply with these standards could potentially lead to a breach of the franchise agreement.
