Answer from 2025 FDD Document

You may not offer or sell any products or services offered by the Business to customers located outside of the Designated Territory. However, you may offer or sell products or services to customers located outside of and adjacent to your Designated Territory if the customer is located in an area that is not serviced by another System franchisee, and you have received prior written approval from us, which approval may be granted or denied at our sole discretion.

What This Means (2025 FDD)

According to Mr. Sandless's 2025 Franchise Disclosure Document, a franchisee needs prior written approval from Mr. Sandless to offer or sell products or services to customers located outside of and adjacent to their Designated Territory if the customer is located in an area that is not serviced by another System franchisee. This approval may be granted or denied at Mr. Sandless's sole discretion. The franchisee's Mr. Sandless business must operate within the designated territory outlined in the Data Sheet or Attachment 2 of the Franchise Agreement.

This means that a Mr. Sandless franchisee cannot simply move their business location without considering the implications for their designated territory. If the new location falls outside the original territory, or even adjacent to it but potentially impacting other franchisees, written approval is necessary. This protects the existing franchisees and maintains the integrity of the franchise system.

It is important to note that even if the move seems beneficial, Mr. Sandless retains the right to deny the relocation request. This highlights the importance of carefully selecting the initial location and understanding the terms of the franchise agreement regarding territory and relocation. A prospective franchisee should discuss territory boundaries and relocation policies with Mr. Sandless before signing the agreement.
