Can Mr. Sandless use the Advertising Fund to include 'Franchises Available' in advertisements?
Mr_Sandless Franchise · 2025 FDDAnswer from 2025 FDD Document
While we do not anticipate that any part of Advertising Fund contributions will be used for advertising which is principally a solicitation for franchisees, we reserve the right to use the Advertising Fund for public relations or recognition of our brand, for the creation and maintenance of a portion of our Website to be used to explain the franchise offering and solicit potential franchisees, and to include a notation in any advertisement indicating "Franchises Available."

What This Means (2025 FDD)
According to Mr. Sandless's 2025 Franchise Disclosure Document, the company reserves the right to use the Advertising Fund for public relations, brand recognition, and to maintain a portion of their website to explain the franchise offering and solicit potential franchisees. Mr. Sandless also reserves the right to include a notation in any advertisement indicating "Franchises Available."
This means that Mr. Sandless has the discretion to use the Advertising Fund to advertise the availability of franchises. While it is not the primary intention of the fund, Mr. Sandless retains the right to do so. This could be beneficial to the overall brand by attracting new franchisees, which in turn could strengthen the network and potentially lead to increased brand recognition and marketing power.
However, the FDD also states that Mr. Sandless does not anticipate using Advertising Fund contributions principally for soliciting franchisees. This suggests that while the option exists, it may not be a frequent or significant use of the fund. Prospective franchisees should inquire about the specific allocation of the Advertising Fund and how it has been used in the past to promote franchise opportunities versus promoting the Mr. Sandless brand to customers.
It's important for potential franchisees to understand that the use of the Advertising Fund is at Mr. Sandless's sole discretion. While the fund is intended to maximize public recognition and patronage of Mr. Sandless businesses, there is no guarantee that every franchisee will directly benefit from every advertising campaign. This is a common practice in franchising, where advertising benefits are often distributed unevenly across the franchise system.
