What This Means (2025 FDD)
According to Mr. Sandless's 2025 Franchise Disclosure Document, upon termination of the Franchise Agreement, a franchisee is required to take action to cancel registrations related to the use of the Proprietary Marks. This includes electronic addresses, domain names, search engines, or websites that associate the franchisee with Mr. Sandless, the business, or the Proprietary Marks, assuming the franchisee was allowed to establish them. Additionally, trade name or assumed name registrations must be cancelled.
This obligation ensures that after the franchise relationship ends, the franchisee does not continue to represent themselves as being affiliated with Mr. Sandless. This protects the integrity of the Mr. Sandless brand and prevents potential customer confusion. The franchisee must also notify the telephone company and listing agencies about the termination of their right to use any telephone numbers and directory listings associated with the Mr. Sandless name, and authorize the transfer of these to Mr. Sandless or a new franchisee.
Mr. Sandless retains sole rights to all social media accounts, email addresses, telephone numbers, and other listings associated with the Proprietary Marks. The franchisee must provide Mr. Sandless with an undated assignment of the telephone number upon execution of the agreement. These measures are in place to ensure a clean break and prevent any misuse of the Mr. Sandless brand and associated assets after the termination of the franchise agreement.
