What This Means (2025 FDD)
According to Mr. Sandless's 2025 Franchise Disclosure Document, Mr. Sandless has the right to direct all advertising activities. Specifically, Mr. Sandless has sole discretion over creative concepts, materials, and media used, as well as their placement and allocation. This control extends to the use of the Advertising Fund, which is used for national, regional, and local advertising, publicity, and promotion.
However, franchisees are also required to conduct local advertising to promote their franchised business in their designated territory, with a minimum spending of $1,500 each month. Franchisees must submit all sales promotional and advertising materials to Mr. Sandless for review at least 21 days prior to use. Failure to get approval within this period is considered disapproval.
Mr. Sandless also restricts franchisees from having individual websites related to the business or using the Mr. Sandless name in a URL without prior written approval. Franchisees are also prohibited from promoting their business or using the proprietary marks on social media without prior written consent. These stipulations ensure that Mr. Sandless maintains control over its brand image and marketing strategies, while also allowing for local advertising efforts by franchisees within certain guidelines.
