Obligations After Opening
After your Business opens, we will:

- Review your local advertising materials to determine if they comply with our specifications. (Franchise Agreement, Section 13.5)
You must submit to us for our review, at least 21 days prior to your use, samples of all sales promotional and advertising materials you desire to use. Our failure to approve or disapprove the materials within such 21 day period will be deemed disapproval. You may not use any advertising or promotional materials for which we have has not given our specific, prior written approval. At our request, you must include certain language in your local advertising and promotional materials, such as "Franchises Available" and our website address and telephone number.
You must contribute each month to the Advertising Fund an amount equal to 1% of your Gross Sales. Your contributions to the Advertising Fund are in addition to your local advertising requirement described above. The Advertising Fund will be used for national, regional and local advertising, publicity and promotion relating to our business. We will determine, in our fully unrestricted discretion, the manner in which the Advertising Fund will be spent.
We may periodically assist franchises to maintain high quality standards through customer surveys, customer interviews, and other similar initiatives ("Surveys"). The cost of these programs will be paid by the Advertising Fund; however, the cost of these programs may be charged directly to you if your results of a Survey fall below System established minimum standards for Surveys.

What This Means (2025 FDD)
According to Mr. Sandless's 2025 Franchise Disclosure Document, Mr. Sandless will review a franchisee's local advertising materials to ensure they meet the franchisor's specifications. Specifically, Mr. Sandless is not required to provide franchisees with any assistance except for what is listed in the FDD. After a Mr. Sandless business opens, the franchisor will review local advertising materials to determine if they comply with their specifications.
Prior to using any sales promotional and advertising materials, a franchisee must submit samples to Mr. Sandless for review at least 21 days before their intended use. If Mr. Sandless fails to approve or disapprove the materials within this 21-day period, the materials are deemed disapproved. Franchisees cannot use any advertising or promotional materials without Mr. Sandless's specific, prior written approval. Mr. Sandless may also request that franchisees include specific language in their local advertising and promotional materials, such as "Franchises Available" and the Mr. Sandless website address and telephone number.
Mr. Sandless also maintains an Advertising Fund, where franchisees must contribute 1% of their gross sales each month. These funds are used for national, regional, and local advertising, publicity, and promotion of Mr. Sandless businesses. Mr. Sandless has sole discretion over how the Advertising Fund is spent, including the creative concepts, materials, and media used. Mr. Sandless may also assist franchisees in maintaining high-quality standards through customer surveys and interviews, with the cost potentially charged to the franchisee if their survey results fall below system-established minimum standards.
