You are not permitted to solicit customers and/or advertise outside the Designated Territory, except to the extent that you have received our prior written approval to do so. What This Means (2025 FDD)
According to Mr. Sandless's 2025 Franchise Disclosure Document, Item 16 and section 13.2 of Item 22 contain information regarding customer solicitation restrictions. Item 16 states that franchisees are not restricted as to the customers whom they may solicit or service except as described in Item 12. Section 13.2 of Item 22 details territorial marketing restrictions.
Specifically, Mr. Sandless franchisees are generally not permitted to solicit customers or advertise outside of their designated territory unless they receive prior written approval from Mr. Sandless. This approval is at Mr. Sandless's sole discretion and may be conditioned on the franchisee offering other Mr. Sandless franchisees in contiguous territories the opportunity to participate in and share the expense of such solicitation or advertising.
Furthermore, franchisees may not advertise their Mr. Sandless business or any products or services offered by the business via the Internet without prior written consent from Mr. Sandless, which may be given or withheld at their sole discretion. However, the FDD notes that certain advertising methods, such as radio and television, may reach a larger audience outside of the designated territory. In such cases, as long as the franchisee offers other Mr. Sandless franchisees the opportunity to participate in such advertising, they will not be in violation of the agreement.
