What This Means (2025 FDD)
According to Mr. Sandless's 2025 Franchise Disclosure Document, Mr. Sandless does not guarantee the approval of any particular supplier. While franchisees can propose new suppliers, Mr. Sandless retains the right to disapprove them.
Mr. Sandless has a 15-day period to approve or disapprove a proposed product, service, or supplier. Failure to respond within this timeframe constitutes disapproval. Even if Mr. Sandless approves a new supplier at a franchisee's request, the approval is limited to the specific product, service, or supplier for which it was granted. Mr. Sandless may also require the franchisee or supplier to reimburse its reasonable testing costs, up to $500, regardless of whether the item or supplier is ultimately approved.
Mr. Sandless may base its approval decisions on factors beyond just the item or supplier, considering the uniformity, efficiency, and quality of the overall Mr. Sandless system. Mr. Sandless also has the right to receive payments from suppliers based on their dealings with franchisees and can use these funds as it sees fit. Mr. Sandless is not obligated to approve an unreasonable number of suppliers if it believes that doing so would lead to higher costs or make supervision more difficult. Mr. Sandless can revoke approval of products or suppliers if they no longer meet its standards, and franchisees must then cease purchasing from them.
Franchisees are required to purchase products from approved suppliers solely for use in their Mr. Sandless business and not for any competitive purposes. Using unapproved products, solutions, or supplies can result in a fine of $2,500 per day and risk termination of the franchise agreement.
