What This Means (2025 FDD)
According to Mr. Sandless's 2025 Franchise Disclosure Document, before a franchisee can bring a dispute to a third party, they must first bring the dispute or claim to the President of Mr. Sandless for discussion. This initial step is a prerequisite before pursuing mediation or litigation.
Following this initial discussion with the President, Mr. Sandless has the option to require that all claims or disputes related to the Franchise Agreement be submitted first to mediation. This mediation would take place in Delaware County, Pennsylvania, under the National Franchise Mediation Program (NFMP), following the NFMP's mediation rules.
If mediation does not resolve the dispute, the FDD specifies that, subject to state law, litigation must occur in a court of general jurisdiction in Delaware County, Pennsylvania, or the United States District Court for the Eastern District of Pennsylvania. The Franchise Agreement is governed by the laws of Pennsylvania, again subject to state law.
