What This Means (2025 FDD)
According to the 2025 Mr. Sandless FDD, franchisees are prohibited from engaging in activities that could harm the brand's reputation. Specifically, franchisees must not hinder Mr. Sandless from using or licensing its Proprietary Marks. This includes refraining from actions that could negatively impact the brand's image or goodwill. Franchisees also cannot use the Proprietary Marks as part of a website domain name without prior written consent from Mr. Sandless.
Mr. Sandless maintains control over the brand's online presence, including the System website, and franchisees must participate in any System-wide computer network implemented by Mr. Sandless. Franchisees are restricted from advertising outside their designated territory without prior written approval, and any unapproved marketing efforts can result in a fine of $500 per occurrence.
Upon termination of the Franchise Agreement, franchisees must immediately discontinue all advertising under the Mr. Sandless name, de-identify service vehicles and office locations, and cancel registrations relating to the use of Proprietary Marks. They must also transfer all rights and interests in social media accounts, electronic mail addresses, telephone numbers, and other listings associated with the Proprietary Marks to Mr. Sandless. These measures ensure that franchisees do not take actions that could damage the Mr. Sandless brand, especially after the franchise relationship ends.
