What This Means (2025 FDD)
According to the 2025 Mr. Sandless Franchise Disclosure Document, the Franchise Agreement cannot be changed or terminated orally. The FDD states that the Franchisee acknowledges that the Franchise Agreement contains all oral and written agreements, representations, and arrangements between the parties. It also specifies that any prior contracts are canceled and terminated by the Franchise Agreement.
This provision is fairly standard in franchising. It ensures that all agreements are documented in writing to avoid misunderstandings or disputes later on. It protects both Mr. Sandless and the franchisee by providing a clear record of the terms and conditions.
As a prospective franchisee, it is crucial to understand that any promises or agreements made by Mr. Sandless representatives that are not included in the written Franchise Agreement are not legally binding. Therefore, it is important to ensure that all important terms and conditions are included in the written agreement before signing. Franchisees should also be aware that they are acknowledging that they understand all the terms and conditions of the Franchise Agreement when they sign it.
