Can the Mr. Sandless Advertising Fund be used for public relations or recognition of the Mr. Sandless brand?

According to Mr. Sandless's 2025 Franchise Disclosure Document, the Advertising Fund can be used for public relations or recognition of the Mr. Sandless brand. While it's not the primary intention, Mr. Sandless reserves the right to use the Advertising Fund for these purposes. Additionally, the fund can be used for creating and maintaining a website, including sections that explain the franchise offering and solicit potential franchisees, and to include a notation in any advertisement indicating "Franchises Available."

This means that a portion of the advertising fees that franchisees contribute could be used to enhance the overall brand image and attract new franchisees, rather than solely focusing on direct consumer advertising. While this benefits the franchisor, it can also indirectly benefit franchisees by strengthening the brand's reputation and market presence.

Mr. Sandless has the sole right to determine how the Advertising Fund is spent, with the understanding that they will make a good faith effort to expend contributions in the general best interests of the System on a national or regional basis. However, the FDD states that neither you nor any other System franchisees will benefit directly or on a pro rata basis from such expenditures.
