While we do not anticipate that any part of the Advertising Fund contributions will be used for advertising which is principally a solicitation for franchisees, we reserve the right to use the Advertising Fund for public relations or recognition of the Mr.

Sandless brand, for the creation and maintenance of a Website, a portion of which can be used to explain the franchise offering and solicit potential franchisees, and to include a notation in any advertisement indicating "Franchises Available."

What This Means (2025 FDD)

According to the 2025 Mr. Sandless Franchise Disclosure Document, while it is not anticipated that the Advertising Fund will be used primarily for franchisee solicitation, Mr. Sandless reserves the right to use the fund for public relations, brand recognition, and the creation/maintenance of a website, a portion of which can be used to explain the franchise offering and solicit potential franchisees. Additionally, Mr. Sandless can include a notation in any advertisement indicating "Franchises Available."

This means that while the primary intention of the Advertising Fund is to promote Mr. Sandless's products and services, there is a provision that allows the company to use a portion of the fund to attract new franchisees. This could involve highlighting the franchise opportunity on the Mr. Sandless website or including a brief message about franchise availability in broader advertising campaigns.

For a prospective franchisee, this implies that the Advertising Fund, to which they contribute a percentage of their gross sales, may indirectly support the growth of the Mr. Sandless franchise system. However, the FDD makes it clear that the fund's main purpose is for general advertising to benefit the system as a whole, and any use for franchisee recruitment would likely be a secondary consideration. Franchisees should inquire about the specific allocation of the Advertising Fund and the extent to which it is used for franchisee recruitment versus general marketing efforts.
