Under what condition will Monicals Pizza make an assignment of the Franchise Agreement?

According to the 2025 Monicals Pizza Franchise Disclosure Document, Monicals Pizza requires the franchisee to assign their interest in the lease for the Approved Location to Monicals Pizza upon termination or expiration of the Franchise Agreement. This is provided that an assignment is not prohibited, and Monicals Pizza approved the form of lease containing such prohibition.

Specifically, the franchisee must assign (or sublease if assignment is prohibited and the lease form was approved by Monicals Pizza) their lease interest to Monicals Pizza. This assignment or sublease must cover the full remaining term of the lease and maintain the same terms and conditions as the original lease. The franchisee is then required to provide Monicals Pizza with evidence of compliance within 30 days of the termination or expiration of the Franchise Agreement.

Monicals Pizza retains the right to directly pay rent and other expenses to the party to whom payment is ultimately due, ensuring the lease remains in good standing. This provision ensures that Monicals Pizza can maintain control over the restaurant location, either for a new franchisee or for other business purposes, after a franchise agreement ends.
