If a franchisee has a potential site for a Monicals Pizza franchised restaurant, what must they do?

We do not typically own the premises you will lease for the franchised restaurant. If you have a potential site for the franchised restaurant, you may propose the location for our consideration. We may consent to the site after we have evaluated it. If you do not have a proposed site, we will designate a geographic area within which you must locate the franchised restaurant and we will furnish you with our general site selection criteria. You are solely responsible for locating and obtaining a site that meets our standards and criteria and that is acceptable to us. (Franchise Agreement, Sections 2.3 and 5.1) If you are signing an Area Development Agreement, the cite specifications requirements may different from the requirements of franchise agreement included in this Franchise Disclosure Document.
The general site selection and evaluation criteria which we consider in approving your site includes the condition of the premises, demographics of the surrounding area, proximity to other Monical's restaurants, proximity to competitive businesses, lease requirements, traffic patterns, visibility, vehicular and pedestrian access, proximity to major roads, ease of ingress and egress, available parking and overall suitability. We will provide you with written notice of our approval or disapproval of any proposed site within a reasonable time after receiving all requested information. If you and we cannot agree on a suitable
site for the franchised restaurant within 90 days after signing the Franchise Agreement, we may terminate the Franchise Agreement. (Franchise Agreement, Section 5.2)
If you are a developer, you must locate each of your franchised restaurants in the development territory, and for each, you must propose the specific sites for our consideration, according to the process above. (Development Agreement, Section 2.1)

What This Means (2025 FDD)
According to Monicals Pizza's 2025 Franchise Disclosure Document, if a franchisee has a potential site for their restaurant, they may propose the location to Monicals Pizza for consideration. Monicals Pizza may then consent to the site after evaluating it. If the franchisee does not have a proposed site, Monicals Pizza will designate a geographic area where the restaurant must be located and provide general site selection criteria.
The franchisee is solely responsible for finding and securing a site that meets Monicals Pizza's standards and criteria and is acceptable to them. Monicals Pizza will provide written notice of approval or disapproval within a reasonable time after receiving all requested information. If the franchisee and Monicals Pizza cannot agree on a suitable site within 90 days after signing the Franchise Agreement, Monicals Pizza may terminate the agreement. If the franchisee is an area developer, they must locate each restaurant within their development territory and propose specific sites for consideration, following the same process.
