What This Means (2025 FDD)

According to the 2025 Monicals Pizza Franchise Disclosure Document, the 'Designated Area' is defined in the context of site selection for a new franchise location. Specifically, if an approved location for the Monicals Pizza restaurant is not identified by the effective date of the franchise agreement, a 'Designated Area' is established.

The 'Designated Area' serves as a temporary geographic area within which the franchisee must propose potential sites for the Monicals Pizza Franchisor to evaluate. Once a site is proposed by the franchisee and approved by Monicals Pizza, the address of this approved location is then added to Section 2.2 of the franchise agreement. Upon this addition, the 'Designated Area' then lapses.

It is important to note that the 'Designated Area' is solely for the purpose of site selection and does not grant the franchisee any territorial exclusivity or protection. This means that even within the 'Designated Area', Monicals Pizza could potentially establish other franchises or operate its own restaurants. The franchisee's exclusive territory, if any, is defined separately as the 'Area of Primary Responsibility'.
