What This Means (2025 FDD)
According to the 2025 Monicals Pizza Franchise Disclosure Document, a prospective franchisee should carefully read the entire document and all associated agreements. The FDD summarizes key provisions of the Franchise Agreement. Monicals Pizza must provide the Disclosure Document to the prospective franchisee at least 14 calendar days before they sign a binding agreement or make any payment to Monicals Pizza or its affiliates related to the franchise sale. This 14-day period allows the franchisee adequate time to review the document and seek professional advice.
After reviewing the FDD, the prospective franchisee should sign and date the receipt included with the document, returning one copy to Monicals Pizza and keeping the other copy for their own records. This receipt acknowledges that the franchisee received the FDD and its exhibits. The exhibits include critical information such as the list of state administrators, list of state agents for service of process, the Franchise Agreement, table of contents of the Confidential Operations Manual, Area Development Agreement, financial statements, lists of current and terminated franchisees, list of company-owned units, the Franchisee Disclosure Questionnaire, and any multi-state addenda.
If a prospective Monicals Pizza franchisee believes that the Disclosure Document was not delivered on time, or that it contains false, misleading, or omits material information, they should report this to the Federal Trade Commission and the State administrator listed in Exhibit A of the FDD. Furthermore, before entering into a Franchise Agreement, Monicals Pizza urges the franchisee to consult with their own advisors regarding the legal, financial, and other aspects of the agreement and the potential business. The franchisee must also confirm that all information provided to Monicals Pizza is true, complete, and accurate.
Finally, the Franchisee Disclosure Questionnaire included as Exhibit I requires the prospective franchisee to confirm in writing that they have reviewed the Franchise Agreement and the Disclosure Document, and that they understand all the information contained within these documents. If there are parts of the Franchise Agreement that the franchisee does not understand, they should specify those parts in the questionnaire. This questionnaire helps Monicals Pizza ensure that the franchisee is fully informed before entering into the agreement.
