What This Means (2025 FDD)
According to the 2025 Moe's Southwest Grill Franchise Disclosure Document, as a franchisee, you will conduct business under the service mark "Moe's Southwest Grill®" and any other identifying marks, trade names, logos and symbols that Moe's uses now, or that they later develop, also known as the Proprietary Marks or Marks. Franchisees will also use Moe's unique system for the establishment, development, and operation of a Restaurant, referred to as the System.
This means that when operating a Moe's Southwest Grill franchise, you are required to use the brand's established name and associated branding elements. This ensures consistency across all franchise locations and reinforces brand recognition among customers. The franchise agreement grants you the right to use these marks and the System, but also obligates you to do so in the manner prescribed by Moe's Southwest Grill.
The use of the Proprietary Marks and System is central to the franchise model. It allows franchisees to benefit from the goodwill and reputation that Moe's Southwest Grill has built. However, it also means that franchisees must adhere to the franchisor's standards and guidelines in order to maintain the integrity of the brand. This includes using approved signage, marketing materials, and operational procedures.
